Terms of Service

1. Acceptance of Terms

By accessing or using RealTCT (“the Platform”), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately discontinue all use of the Platform.

2. User Accounts

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and up-to-date information
• Notifying us immediately of any unauthorized access

3. Property Listings

When posting property listings, you represent, warrant, and agree that:

• You have legal authority to list the property — you are the registered owner, a licensed real estate broker/salesperson with a valid listing authority, or a duly authorized representative
• You can provide proof of authority (e.g., title, tax declaration, Special Power of Attorney, broker authority letter, or PRC license) upon request
• All property information is accurate, current, and not misleading
• You own the rights to all photos and content uploaded, or have obtained proper permission
• You comply with all applicable Philippine real estate laws and regulations
• You will not post fraudulent, misleading, duplicated, or illegal content

Listings identified as unofficial or informational (e.g., development pages sourced from publicly available data) are not subject to the above authority requirement, provided they include appropriate disclaimers.

4. Content License & Marketing Rights

By uploading content on RealTCT — including property listings, photographs, images, videos, descriptions, and other materials (“User Content”) — you grant RealTCT a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, display, distribute, and create derivative works from your User Content for any purpose, including:

• Platform Operations: Displaying your listings on RealTCT and affiliated websites or applications
• Promotional & Marketing Materials: Featuring your content in advertisements and marketing campaigns across all media
• Social Media Marketing: Sharing and promoting your content on Facebook, Instagram, YouTube, TikTok, LinkedIn, Twitter/X, Pinterest, Viber, Telegram, and other platforms
• Partner & Affiliate Distribution: Syndicating your listings to third-party portals and partner websites
• Aggregated & Analytical Use: Using anonymized or aggregated content for market analysis and research

You retain ownership of your User Content. This license does not transfer ownership to RealTCT. By posting content, you acknowledge that RealTCT may use your materials as described above without additional notice, compensation, or approval. If you do not wish your content to be used for marketing purposes, you must remove the content from the Platform or contact us through our contact form to request exclusion.

You represent and warrant that: (a) you own or have the necessary rights to grant the above license; (b) your User Content does not infringe any third-party rights; and (c) you have obtained any necessary consent from individuals depicted in your content.

5. Subscription Plans, Features & Add-Ons

RealTCT offers multiple subscription tiers with varying features, listing limits, and optional add-ons. Current pricing and plan details are displayed on our Subscription page. Subscriptions renew automatically. You may cancel at any time from your account settings.

RealTCT reserves the right, at its sole discretion and at any time without prior notice, to modify any aspect of its subscription plans, including pricing, features, add-ons, listing limits, tier structure, and billing terms. Continued use of the Platform after any modification constitutes acceptance of the updated terms.

6. Social Media Auto-Posting

When you connect social media accounts:

• You authorize RealTCT to post content on your behalf
• You remain responsible for all content posted
• You must comply with each platform's terms of service
• RealTCT is not liable for content removed or flagged by social platforms
• You can disconnect accounts at any time

7. AI-Generated Content

Our AI tools generate property descriptions and social media posts:

• You are responsible for reviewing and approving all AI-generated content
• RealTCT does not guarantee accuracy or suitability of AI content
• You retain ownership of content generated using your property data

8. Content Policy & Prohibited Activities

You agree NOT to:

• Post false or misleading property information
• Violate any laws or regulations
• Infringe on intellectual property rights
• Attempt to hack or disrupt our services
• Scrape or copy data for commercial purposes
• Spam or send unsolicited messages
• Impersonate others
• Use bots or automated tools to access the Platform without written permission
• Circumvent or manipulate listing limits, subscription features, or quota restrictions

9. Payment, Billing, and Refunds

9.1 Payment Processing

• All fees are in Philippine Pesos (₱)
• Subscriptions are billed monthly or annually in advance
• All payments are processed exclusively by PayMongo, a BSP-licensed payment service provider. RealTCT never receives, stores, or has access to your credit card number, bank details, or e-wallet credentials.
• PayMongo will send you a payment receipt email directly upon successful payment

9.2 Refunds and Disputes

• Refund requests must be directed to PayMongo, our payment processor
• For billing disputes or chargebacks, contact PayMongo directly or your bank/card issuer
• Unused subscription time is not refundable. Cancellation stops future billing but does not entitle you to a refund for the current billing period.

9.3 Auto-Renewal

• Paid subscriptions auto-renew unless cancelled
• You may disable auto-renewal at any time from your Account Settings
• If auto-renewal fails (e.g., expired card), your subscription will be downgraded to the Free tier

10. Achievement Points & Rewards Program

RealTCT offers an Achievement Points program that allows users to earn points through platform activities.

10.1 Earning Points

• Points are earned by completing achievements (listing properties, verifying identity, referring users, etc.)
• Points are credited immediately upon achievement completion
• Fraudulent attempts to earn points may result in account termination

10.2 Redeeming Points

• Points can be redeemed for add-on features and subscription discounts
• Redemptions are final and cannot be reversed
• RealTCT reserves the right to modify redemption values

10.3 Important Limitations

• Points have no monetary value and cannot be exchanged for cash or transferred to other users
• Points do not expire as long as your account remains active
• All unredeemed points are forfeited upon account termination

10.4 Program Modifications

RealTCT reserves the right to modify, suspend, or terminate the rewards program at any time, including adjusting point values, rewards catalog, conversion rates, and earning activities. Points already earned remain in your account unless the program is terminated. Continued use constitutes acceptance of any changes.

11. Cancellation and Subscription Policy

• Cancellation: You may cancel your subscription at any time from Account Settings. Access continues until the end of your current billing period.
• Downgrade: Plan downgrades are scheduled for the end of your billing period. You retain higher-tier features until expiration.
• Refunds: All refund requests must be directed to PayMongo. See Section 9.2.
• Free Tier: The free tier has no charges and can be used indefinitely with basic feature limits.

12. Termination

We may terminate or suspend your account if:

• You violate these terms
• You post fraudulent or illegal content
• Your account is involved in abuse or spam
• Payment fails multiple times
• Your account has been inactive for more than 12 consecutive months

Upon termination: (a) your right to use the Platform ceases immediately; (b) we may delete your account data, listings, and uploaded content after a 30-day grace period; (c) any outstanding payment obligations survive termination.

13. Limitation of Liability

RealTCT is provided “as is” and “as available” without warranties of any kind. We are not liable for:

• Losses from using the platform
• Inaccurate property information posted by users
• Third-party services (social media platforms, payment processors)
• Service interruptions or technical issues
• Loss or reduction of Achievement Points value
• Any property transactions between users facilitated through the Platform
• AI-generated content, market analyses, or estimates that prove inaccurate
• Loss of data, revenue, or business opportunities

To the maximum extent permitted by Philippine law, RealTCT's total cumulative liability shall not exceed the total amount you have paid in subscription fees during the twelve (12) months preceding the event giving rise to the claim. For free-tier users, maximum liability is ₱0.

14. Platform Role & Transaction Disclaimer

RealTCT is a technology platform that provides listing, marketing, and informational services for real estate professionals and property seekers. RealTCT is NOT:

• A real estate broker, agent, salesperson, or developer
• A party to any real estate transaction between users or between users and third parties
• A guarantor of any property's condition, title, legality, ownership, or value
• A licensed real estate appraiser — AI Market Analysis is for informational purposes only
• An authority on the accuracy or completeness of development project information

RealTCT may receive advertising, promotional, or referral fees from developers, brokers, or other third parties. Such commercial arrangements do not constitute an endorsement of any property, development, or service, and do not create any agency, brokerage, or fiduciary relationship.

Users are solely responsible for conducting their own due diligence and engaging licensed real estate professionals before entering into any property transaction. All content on the Platform is for informational purposes only and should not be construed as professional real estate advice.

15. AI Market Analysis Disclaimer

The AI Market Analysis feature provides estimated market insights for informational purposes only. By using this feature, you acknowledge that:

• AI-generated estimates are not professional appraisals and must not be relied upon for legal, financial, or transactional purposes
• Only a PRC-licensed real estate appraiser can provide an official property valuation under Philippine law
• Estimates may be inaccurate due to data limitations or market volatility
• RealTCT does not guarantee the accuracy of any AI-generated analysis

16. No Guarantee of Results

RealTCT does not guarantee any specific outcomes from using the Platform, including number of views or inquiries, speed of selling or renting, accuracy of analytics, or effectiveness of marketing features. Results depend on market conditions, pricing, content quality, and factors beyond our control.

17. Indemnification

You agree to indemnify, defend, and hold harmless RealTCT, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from your use of the Platform, violation of these Terms, content you upload, your interaction with other users, or your infringement of any third-party rights.

18. Intellectual Property

The RealTCT name, logo, trademarks, software, website design, AI models, and all related intellectual property are owned exclusively by RealTCT and its licensors. You may not:

• Copy, modify, or reverse-engineer RealTCT's software or platform
• Use the RealTCT brand or trademarks without written permission
• Reproduce or redistribute platform content (other than your own) for commercial purposes

19. Eligibility

You must be at least 18 years old to use RealTCT. By using the Platform, you represent that you are of legal age to form a binding contract under Philippine law. If using the Platform on behalf of a business, you represent that you have authority to bind that entity.

20. Professionals Directory & Contact Information

20.1 Public Profile Visibility

By creating an account as a real estate professional on RealTCT, you acknowledge that your name, profile photo, and service areas may be publicly visible on the professionals directory. This information is displayed to help property seekers find qualified agents, brokers, and salespersons.

20.2 Contact Information Sharing

By providing contact information (phone number, email, messaging app links), you consent to such information being accessible to registered users of the platform for professional networking and property inquiries. Contact details are only visible to registered and logged-in users. RealTCT does not sell or share your contact information with third parties outside the platform. You may control visibility through your dashboard settings.

21. Content Takedown Requests

If you believe any content on RealTCT infringes your rights, contact us through our contact form with the subject “Takedown Request”. Include the URL of the listing, your name, and a brief explanation. We will review requests and take appropriate action. RealTCT does not adjudicate property ownership disputes.

22. Development & Project Information Disclaimer

RealTCT features pages for real estate developments and projects compiled from publicly available sources including developer websites, government filings, and other public records. You acknowledge and agree that:

• Unless otherwise stated, development pages are not owned, managed, endorsed, verified, or affiliated with the respective developers or their authorized representatives
• RealTCT is not the developer, seller, or authorized agent of any real estate development featured on the Platform
• Development information — including pricing, availability, floor plans, amenities, completion dates, and specifications — is provided for informational purposes only and may be outdated, incomplete, or inaccurate
• RealTCT does not guarantee, warrant, or represent the accuracy, completeness, or reliability of any development information displayed
• Featured projects may include links or referral mechanisms to developers or their authorized sellers. Any resulting transaction is solely between you and the developer or their authorized agent — RealTCT is not a party to such transaction
• RealTCT may receive advertising, promotional, or referral fees from developers or third parties in connection with development pages. Such arrangements do not constitute an endorsement of any project and do not create a broker-client or agency relationship
• You should verify all development details directly with the developer or their licensed representatives before making any purchase decision
• All trademarks, project names, logos, and copyrighted materials belong to their respective owners

Developers wishing to claim, update, or request removal of their development page may contact us through our contact form.

23. Dispute Resolution

Any dispute arising from your use of the Platform shall be resolved as follows:

• Good Faith Negotiation: Contact RealTCT through our contact form and attempt to resolve the dispute informally.
• Mediation: If unresolved, parties agree to submit the dispute to mediation under Philippine dispute resolution rules.
• Court Action: If mediation fails, the dispute shall be filed in the proper courts of Metro Manila, Philippines.

24. Governing Law

These Terms are governed by the laws of the Republic of the Philippines. Any legal action shall be brought exclusively in the courts of Metro Manila.

25. Force Majeure

RealTCT shall not be liable for any failure or delay in performing its obligations due to causes beyond its reasonable control, including natural disasters, pandemics, power outages, internet disruptions, government actions, cyberattacks, or third-party service failures.

26. Modifications to Terms

RealTCT may modify these Terms at any time by posting the updated version on this page with a new “Last Updated” date. Your continued use of the Platform after changes constitutes acceptance. If you disagree, your sole remedy is to stop using the Platform and cancel your subscription.

27. General Provisions

• Severability: If any provision is found invalid, the remaining provisions continue in full force.
• Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and RealTCT.
• No Waiver: Failure to enforce any provision does not constitute a waiver.
• Assignment: You may not assign your rights under these Terms without our consent. RealTCT may assign its rights without restriction.
